Terms and Conditions

These Terms and Conditions, together with any policies or terms referenced in them, govern your access to and use of metrin.ca, including any purchases made through metrin.ca. In these Terms and Conditions, we refer to this document as the “Terms.” 

Please read these Terms carefully. By accessing metrin.ca, creating an account, placing an order, submitting content, participating in Metrin Rewards, or otherwise using our website, you agree to be bound by these Terms. 

If you do not agree to these Terms, please do not use metrin.ca. 

1. About These Terms 

These Terms apply to your access to and use of metrin.ca, including any purchases made through metrin.ca. 

metrin.ca is operated by Metrin Life Canada Inc., a federal Canadian corporation with its registered office in British Columbia. In these Terms, “Metrin,” “we,” “us,” and “our” refer to Metrin Life Canada Inc. in connection with metrin.ca and purchases made through metrin.ca. 

Metrin Life Canada Inc. and Metrin Life USA, Inc. are affiliated Metrin entities. The Metrin name, trademarks, product information, website content, and related intellectual property are owned by, licensed to, or used with authorization by Metrin Life Canada Inc., Metrin Life USA, Inc., or one or more affiliated Metrin entities. 

For sections of these Terms that refer to intellectual property, website content, product information, limitation of liability, indemnification, user submissions, testimonials, reviews, privacy coordination, or the protection of Metrin’s business, brand, personnel, licensors, service providers, agents, or representatives, “Metrin Entities” means Metrin Life Canada Inc., Metrin Life USA, Inc., other affiliated Metrin entities, and their respective directors, officers, employees, contractors, licensors, service providers, agents, and representatives. 

2. Website and Store Availability 

metrin.ca primarily serves customers in Canada. Customers located outside Canada should use metrin.com where ordering is available for their destination. 

We may change, suspend, or discontinue any part of metrin.ca at any time, including product availability, website features, content, promotions, shipping destinations, and account features. We may also restrict access to parts of the website where necessary for security, maintenance, legal, operational, or business reasons. 

We do not guarantee that metrin.ca, or any content or feature on metrin.ca, will always be available, uninterrupted, secure, or error-free. 

3. Eligibility and Customer Accounts 

You must be at least the age of majority in your province or territory of residence to place an order through metrin.ca, or you must use the website under the supervision of a parent or legal guardian. 

You may be able to create a customer account to access certain features, view order information, manage preferences, or participate in programs such as Metrin Rewards. You are responsible for maintaining the confidentiality of your account login information and for all activity that occurs under your account. 

You agree to provide accurate, current, and complete information when creating an account or placing an order. You are responsible for keeping your information up to date. 

We may suspend, restrict, or close an account if we believe it has been used fraudulently, unlawfully, abusively, or in violation of these Terms. 

4. Product Information and Cosmetic Use 

Metrin products are cosmetic products for external use only unless expressly stated otherwise. Product descriptions, directions, educational content, routines, ingredient information, testimonials, and other website content are provided for general informational purposes. 

Metrin products and website content are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Nothing on metrin.ca is medical advice. If you have a skin condition, allergy, sensitivity, medical concern, or questions about whether a product is appropriate for you, please consult a qualified health professional before use. 

Individual results vary. Testimonials, reviews, before-and-after descriptions, and customer stories reflect individual experiences and do not guarantee that you will experience the same results. 

You are responsible for reviewing product ingredients, following product directions, and using products appropriately. Discontinue use if irritation occurs. Keep products out of reach of children. 

5. Orders and Order Acceptance 

When you place an order through metrin.ca, you are making an offer to purchase the products in your order. We may accept or decline your order for any reason, including product availability, payment issues, suspected fraud, pricing errors, shipping restrictions, or other operational or legal reasons. 

An order confirmation email means that we have received your order. It does not necessarily mean that your order has been accepted or shipped. We reserve the right to cancel or limit orders, including orders that appear to be placed by resellers, distributors, bots, or other unauthorized parties. 

If we cancel an order after payment has been processed, we will issue a refund for the cancelled portion of the order. 

6. Pricing, Currency, Taxes, and Payment 

Prices on metrin.ca are shown in Canadian dollars unless otherwise stated. 

Prices, promotions, discounts, product availability, and shipping charges may change without notice. We may correct errors, inaccuracies, or omissions at any time, including after an order has been submitted. If a material pricing or product error affects your order, we may cancel the order and issue a refund. 

Applicable taxes, shipping charges, and other charges collected by Metrin will be shown at checkout before you submit your order. 

You agree to provide valid payment information and authorize us, our payment processors, and related service providers to charge the payment method you provide for the total amount shown at checkout. 

We do not store full payment card details on our own systems. Payments are processed by third-party payment providers and are subject to their own terms and security practices. 

7. Shipping and Delivery 

Shipping options, shipping charges, and estimated delivery times will be shown at checkout where available. Estimated delivery times are estimates only and are not guaranteed. 

metrin.ca primarily ships to addresses in Canada. If shipping to a destination is not available at checkout, we do not currently ship to that destination through metrin.ca. 

We are not responsible for delays caused by carriers, weather, incorrect or incomplete delivery information, payment issues, inventory issues, or circumstances beyond our reasonable control. 

If you refuse delivery, provide incorrect delivery information, or fail to collect your shipment, the order may be returned, abandoned, delayed, or destroyed. In those circumstances, you may remain responsible for shipping charges, return costs, and any non-refundable amounts, subject to applicable law. 

8. Returns, Refunds, and 6 Month Guarantee 

Returns, refunds, and guarantee claims are governed by our Return & Refund Policy and, where applicable, our 6 Month Guarantee. Please review those policies before placing an order. 

Certain designated Metrin products may be eligible for our 6 Month Guarantee where expressly stated on the applicable product page, offer page, or Guarantee page. The 6 Month Guarantee applies only to eligible designated products, such as qualifying Metrin full system purchases, and does not automatically apply to all products or all orders. 

For eligible initial purchases covered by the 6 Month Guarantee, customers may request a product refund within 180 days of purchase, subject to the terms of the Guarantee. 

For products or orders not covered by the 6 Month Guarantee, customers may request a return within 30 days of purchase, subject to our Return & Refund Policy. 

Refunds apply to the eligible product purchase price and any taxes required to be refunded by law. Refunds do not include original shipping charges, return shipping charges, or similar charges unless required by law or expressly approved by Metrin. 

Refunds are generally issued after we receive the returned product and confirm that the return is eligible. Refunds are typically processed within 3 to 5 business days after receipt and review of the returned product, although your bank, card issuer, or payment provider may take additional time to post the refund. 

Metrin reserves the right to approve exceptions or alternative return instructions on a case-by-case basis. 

We may deny a return, refund, or guarantee claim if we believe the request is fraudulent, abusive, excessive, inconsistent with the applicable policy, or otherwise not made in good faith. 

9. Promotions, Discounts, Gifts, and Offers 

From time to time, we may offer promotions, discounts, gifts with purchase, referral offers, bundles, free shipping offers, or other special offers. Offers may be subject to additional terms, eligibility requirements, expiration dates, product exclusions, order minimums, or geographic limitations. 

Unless expressly stated otherwise, promotions cannot be combined, applied retroactively, redeemed for cash, transferred, or used after expiration. 

We may modify, suspend, or cancel any offer at any time, subject to applicable law. 

10. Metrin Rewards 

Metrin Rewards, points, discounts, referrals, loyalty benefits, and related promotional benefits are offered at Metrin’s discretion and may be subject to separate Metrin Rewards terms. 

Rewards points and benefits have no cash value, are not your property, and may not be sold, transferred, assigned, or exchanged except as expressly permitted by Metrin. 

Rewards points or benefits may be adjusted, reversed, or cancelled if an order is returned, refunded, cancelled, suspected of fraud, or otherwise found to be ineligible. 

We may modify, suspend, or terminate Metrin Rewards, including earning rates, redemption rates, eligibility rules, referral rules, migrated balances, expiration rules, and available rewards, subject to applicable law and any specific Rewards terms then in effect. 

If there is a conflict between these Terms and specific Metrin Rewards terms, the specific Metrin Rewards terms will apply to the Rewards program. 

11. Subscriptions and Auto-Replenishment 

Metrin does not currently offer subscription, auto-replenishment, or recurring purchase options through metrin.ca unless such options are expressly presented at checkout. 

We may offer subscription, auto-replenishment, or recurring purchase options in the future. If we do, those purchases will be subject to the subscription terms presented at the time of purchase, including billing frequency, cancellation rights, renewal terms, and any required disclosures. 

12. User Content, Reviews, Testimonials, and Submissions 

You may have the opportunity to submit reviews, testimonials, comments, photos, questions, feedback, survey responses, or other content to Metrin or through metrin.ca. We refer to this as “User Content.” 

By submitting User Content, you confirm that: 

  • the content is truthful and based on your own experience; 

  • you have the right to submit it; 

  • it does not infringe the rights of any other person; 

  • it is not false, misleading, defamatory, obscene, abusive, unlawful, or otherwise inappropriate; and 

  • it does not contain another person’s private information without permission. 

By submitting User Content, you grant the Metrin Entities a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable right to use, reproduce, publish, display, edit, excerpt, adapt, translate, distribute, and otherwise exploit the User Content in connection with Metrin’s business, marketing, advertising, website, social media, email, product education, and related communications. 

We may moderate, edit, refuse, remove, or decline to publish User Content at our discretion. We are not required to return, preserve, publish, or compensate you for User Content. 

13. Intellectual Property 

All content on metrin.ca, including text, images, graphics, product names, trademarks, logos, icons, video, audio, website design, educational materials, product information, and other content, is owned by, licensed to, or used with authorization by one or more Metrin Entities or their licensors. 

You may access and use metrin.ca for personal, non-commercial shopping and informational purposes only. You may not copy, reproduce, modify, distribute, display, sell, exploit, scrape, or use any website content, product information, trademarks, or other intellectual property without prior written permission from Metrin or the applicable rights holder. 

Nothing in these Terms grants you any ownership rights in Metrin’s trademarks, website content, product information, formulas, trade dress, or other intellectual property. 

14. Prohibited Uses 

You agree not to use metrin.ca for any unlawful, harmful, fraudulent, abusive, or unauthorized purpose. 

You must not: 

  • violate any applicable law or regulation; 

  • interfere with the operation or security of metrin.ca; 

  • attempt to gain unauthorized access to accounts, systems, or data; 

  • use bots, scrapers, crawlers, automated tools, or similar technologies without permission; 

  • submit false, misleading, or fraudulent information; 

  • impersonate another person or misrepresent your identity; 

  • abuse promotions, rewards, referrals, returns, guarantees, or account features; 

  • resell products without authorization; 

  • upload or transmit malicious code, spam, or harmful content; or 

  • use metrin.ca or Metrin content in a way that harms Metrin, customers, service providers, or other users. 

We may take any action we consider appropriate if we believe these Terms have been violated, including cancelling orders, suspending accounts, limiting access, removing content, reversing rewards, or pursuing available legal remedies. 

15. Third-Party Services and Links 

metrin.ca may use or link to third-party services, including ecommerce platforms, payment processors, shipping carriers, rewards providers, email and SMS providers, analytics providers, review platforms, and other service providers. 

Third-party services may be subject to their own terms, privacy policies, and practices. Metrin is not responsible for third-party websites, platforms, tools, or services that we do not control. 

Links to third-party websites or services are provided for convenience only and do not imply endorsement. 

16. Privacy 

Your use of metrin.ca and your submission of personal information are governed by our Privacy Policy. 

Please review our Privacy Policy to understand how we collect, use, disclose, retain, and protect personal information, and how you may exercise privacy rights that may apply to you. 

If you submit information through metrin.ca, a Contact Us form, a Skin Care Questionnaire, a review, a customer account, checkout, Metrin Rewards, or any other feature, you agree that Metrin may handle that information as described in the Privacy Policy. 

17. Marketing Communications 

You may have the opportunity to subscribe to marketing emails, SMS messages, or other communications from Metrin. Where required by law, we will send marketing communications only with appropriate consent. 

You may unsubscribe from marketing emails by using the unsubscribe link included in those emails. SMS opt-out instructions, if applicable, will be provided in the relevant SMS terms or messages. 

Transactional, service, account, order, shipping, return, security, legal, or policy-related communications may still be sent where permitted or required by law. 

18. Disclaimer of Warranties 

metrin.ca, website content, product information, and related services are provided on an “as is” and “as available” basis. 

To the fullest extent permitted by law, Metrin disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, availability, and uninterrupted or error-free operation. 

Nothing in these Terms limits any warranty, right, or remedy that cannot be excluded or limited under applicable law. 

19. Limitation of Liability 

To the fullest extent permitted by law, the Metrin Entities will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to these Terms, metrin.ca, products, services, orders, delays, returns, rewards, promotions, User Content, or third-party services. 

To the fullest extent permitted by law, the total liability of the Metrin Entities for any claim arising out of or relating to these Terms, metrin.ca, or any purchase made through metrin.ca will not exceed the amount you paid for the product or order giving rise to the claim. 

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, intentional misconduct, or personal injury where such limitation is not permitted by law. 

20. Indemnification 

To the fullest extent permitted by law, you agree to indemnify and hold harmless the Metrin Entities from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or relating to: 

  • your breach of these Terms; 

  • your misuse of metrin.ca; 

  • your violation of applicable law; 

  • your User Content; 

  • your infringement or violation of another person’s rights; 

  • your fraudulent, abusive, or unauthorized conduct; or 

  • your misuse of promotions, rewards, referrals, returns, guarantees, or account features. 

21. Force Majeure 

Metrin will not be responsible for any delay or failure to perform caused by circumstances beyond our reasonable control, including acts of God, natural disasters, severe weather, labor disputes, supply chain disruptions, carrier delays, pandemics, epidemics, public health emergencies, government actions, war, terrorism, civil unrest, cyberattacks, technical failures, utility failures, or other events beyond our reasonable control. 

22. Governing Law and Disputes 

These Terms, your use of metrin.ca, and any purchase made through metrin.ca are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict of law principles. 

Subject to any mandatory consumer protection rights that may apply in your place of residence, any claim or dispute arising from these Terms, your use of metrin.ca, or your purchase of Metrin products through metrin.ca will be resolved by the courts of competent jurisdiction located in British Columbia, Canada. 

Nothing in these Terms limits any non-waivable rights or remedies available to you under applicable consumer protection laws. 

23. Changes to These Terms 

We may update these Terms from time to time. If we make changes, we will update the “Last Updated” date above. The updated Terms will apply when posted unless a different effective date is stated. 

Your continued use of metrin.ca after updated Terms are posted means that you accept the updated Terms, subject to applicable law. 

24. Severability 

If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be interpreted or limited to the minimum extent necessary, and the remaining parts of these Terms will remain in effect. 

25. Entire Agreement 

These Terms, together with any policies, notices, or additional terms referenced in them, form the entire agreement between you and Metrin regarding your use of metrin.ca and purchases made through metrin.ca.
